The initial adjudication issued by Judge Gilmar Mendes suspended a previous decision issued by a lower court last December, and returned Rodriguez, who is considered the first black president in the history of the Brazilian Federation, to his position.
Brazilian football has faced a storm of responses recently against the backdrop of the legal-political conflict, in addition to the decline in the performance of the Brazilian team and the threat of the International Federation (FIFA) to suspend the activities of the Brazilian teams internationally unless Rodigich is returned to his position.
The judge’s decision stated, “I suspend the effects of the ruling issued by the Rio de Janeiro Court of Justice. and order the immediate return to their positions of the leadership elected by the General Assembly of the Brazilian Football Confederation, on March 23, 2022.”
This step is followed by the submission of the preliminary ruling to the 11-member Supreme Court.
A lower court had previously invalidated an agreement between the Brazilian Federation and the Rio Public Prosecutor’s Office, dating back to March 2022, which later allowed Rodriguez to be elected as head of the Federation until 2026.
The case dates back to 2017, when the Brazilian Federation changed its election laws without consulting representatives of the first division clubs in Brazil, whose voting power was weakened.
The former president of the federation and election winner, Rogerio Caboclo, was removed from his position in 2021, following accusations of sexual harassment against him.
Rodriguez replaced him temporarily at that time.
A court in Rio later annulled Caboclo’s election due to a change in rules, and Rodriguez won.
